Too often it comes to warranty without knowing in depth the difference between Legal and Commercial Warranty. These same vendors do not adequately inform the buyer of the real manufacturer warranty on the purchased goods, except to say that the product purchased has a two year warranty.

For its part the buyer does not read carefully the warranty certificate of the property purchased and is not aware that the good often has only a one-year commercial warranty.

In this regard EcoGreenShop want to help all buyers of electrical / electronic devices in detail by describing the difference between the two guarantees that are both valid at the time of purchase.

Warranty Legal & Commercial

Directive 99/44 / EC, and the individual national implementing regulations (for Italy the Legislative Decree no. 24 of February 2, 2002) introduced a new system of guarantees for movable property purchased by consumers intending to "consumer" only "one who uses the asset for purposes unrelated to business or professional activity eventually carried out *" (home / private use).

For this reason these new standards did not change anything in the customer / supplier relationships with regard to purchases made by invoice (for which still worth the commercial guarantee period of twelve months).

The "legal guarantee of two years" required by the Directive is paid directly by the seller and the consumer is liable for any "lack of conformity with the sales contract" that is coming into play whenever the consumer finds a difference between the stated characteristics of a product and those of the purchased own. It is a guarantee for any lack of conformity or defect of lack of promised features and concerns an issue that has characterized the good from the beginning.

In these cases the consumer has the right to request the intervention of the legal guarantee, because the purchase contract was not respected or because it has been given a good different than expected. In case of lack of conformity in the warranty period of twenty-four months EcoGreenShop undertakes to repair or replace the product or any component that might be marred by a manufacturing defect.

The warranty does not cover normal wear. Although there are no any rights in this regard EcoGreenShop, in case of replacement of goods not in conformity, it reserves the right to replace it with another later and of equal value or, alternatively, to issue a voucher for the same amount spent on another good product for 6 (six) months from the time of release.

Alongside the legal warranty that comes from the implementation of Directive 99/44 / EC, there is a second form of guarantee called commercial guarantee which is in effect a smooth operation: it does not guarantee the absence of original vices, but the fact we do not have certain defects through use protracted.

The duration of this commercial guarantee is limited to twelve months except exceptions explicitly signaled by the manufacturer directly on the invoice or on the warranty certificate.

There is no right to claim your warranty if - the defect or damage was caused by improper use.

They define non-compliance such as the following actions: Repairs or interventions carried out by persons not authorized by the manufacturer to the opening apparatus (has the same value of the intervention of an unauthorized third party) - assembly of components manipulation - manipulation software - defects or damage caused by falling, breaking, lightning or ingress of liquids. Moreover, even if defects or damage were caused by mechanical influences, electrical, chemical, thermal and radio (eg microwave, sauna, power surges,.: ..) - Devices with additions or accessories not approved by the manufacturer according art.5 of Directive 99/44 / EC, the customer to exercise his rights, he shall have the burden to denounce the lack of conformity within two months from the date on which he detected such lack. In the case of replacement of the product or component, product or individual parts made in the face of change, become property of the manufacturer.

The warranty executed performance does not prolong the warranty period. Therefore, in case of replacement of the product or one of its components, the good or the component provided to replace this does not initiate a new warranty period but must take account of the date of the original fine. Rules governing the assets sold for Entrepreneurial Warranty or Professional activities

In case of purchases for Entrepreneurial or Professional activities (sales with invoice and VAT) the guarantee is valid only the Commercial which is usually of twelve months, unless other guarantees offered by manufacturers.
